Overview & Purpose
This Acceptable Use Policy (“AUP”) establishes the acceptable, prohibited, and restricted uses of the WiseLiquid platform, APIs, communication infrastructure, dashboards, delivery gateways, and related services (collectively, the “Services”).
This AUP is intended to protect our customers, recipients, telecommunications and messaging networks, service providers, and WiseLiquid infrastructure from abuse, fraud, unlawful activity, spam, security threats, and activities that may negatively affect service reliability or reputation.
By accessing or using the Services, you agree to comply with this AUP and ensure that your employees, contractors, customers, sub-accounts, agents, developers, and other authorized users comply with it.
01. Scope & Application
This AUP applies to all users of WiseLiquid Services, including:
- Direct customers and enterprise customers
- Developers and API users
- Resellers, distributors, and technology partners
- Sub-accounts and managed accounts
- Users accessing the WiseLiquid dashboard or web applications
- Customers using SMS, Email, RCS, WhatsApp, voice, or other communication channels made available through the platform
- Any third party using WiseLiquid Services on behalf of a customer
Customers are responsible for all communications sent through their accounts, including communications initiated by their users, applications, integrations, sub-accounts, or customers.
Use of WiseLiquid Services does not transfer responsibility for compliance to WiseLiquid. Each customer remains responsible for ensuring that its use of the Services complies with applicable laws, regulations, carrier requirements, industry standards, and contractual obligations.
02. Lawful & Authorized Use
You may use the Services only for legitimate and lawful business, transactional, informational, operational, or other permitted communication purposes.
You must:
- Have a lawful basis for sending communications.
- Obtain and maintain appropriate recipient consent where required.
- Provide accurate sender identification.
- Honor recipient opt-out and unsubscribe requests.
- Maintain appropriate records of consent and communication activity.
- Comply with applicable telecommunications, privacy, data-protection, consumer-protection, anti-spam, advertising, and electronic communications laws.
- Comply with applicable carrier, operator, messaging-provider, channel-specific, and regulatory requirements.
- Ensure that your content, sender identity, links, domains, phone numbers, and other communication elements are not deceptive or misleading.
For communications sent in India, customers are additionally responsible for complying with applicable TRAI, DLT, telecom operator, sender ID, template, consent, and messaging requirements applicable to their communications.
Where a particular channel or jurisdiction imposes additional requirements, those requirements apply in addition to this AUP.
03. Prohibited Content & Activities
You must not use WiseLiquid Services to transmit, distribute, facilitate, or promote content or activities that are unlawful, fraudulent, deceptive, abusive, harmful, or otherwise prohibited.
3.1 Fraud, Phishing & Impersonation
Prohibited activities include:
- Phishing or credential theft.
- Account takeover attempts.
- Identity theft.
- Impersonating banks, financial institutions, government agencies, delivery companies, technology providers, or other organizations.
- Fraudulent payment or refund requests.
- Fake invoices, payment links, or verification requests.
- Messages designed to obtain passwords, authentication codes, financial information, or other sensitive information unlawfully.
- Spoofing sender identities or using deceptive sender information.
3.2 Spam & Unsolicited Communications
You must not use the Services for:
- Unsolicited bulk messaging.
- Spam or indiscriminate commercial messaging.
- Purchased, scraped, harvested, or unlawfully obtained recipient lists.
- Repeated messages to recipients who have opted out.
- Sending communications without legally required consent.
- Concealing unsubscribe mechanisms where required.
- Circumventing carrier or provider filtering mechanisms to deliver unwanted communications.
Recipients must be able to exercise applicable opt-out or unsubscribe rights through appropriate mechanisms.
3.3 Illegal Goods & Services
You may not use WiseLiquid Services to promote, facilitate, advertise, sell, distribute, or provide access to unlawful goods or services, including:
- Illegal drugs or controlled substances.
- Illegal gambling or betting services.
- Fraudulent financial products or schemes.
- Unlicensed pharmaceutical products where prohibited by law.
- Counterfeit goods.
- Stolen goods or services.
- Services intended to facilitate criminal activity.
- Other goods or services prohibited by applicable law or telecommunications regulations.
3.4 Harmful, Abusive & Illegal Content
Prohibited content includes:
- Content that facilitates serious criminal activity.
- Credible threats of violence.
- Terrorist or extremist recruitment or operational activity.
- Content encouraging violence against individuals or protected groups.
- Child sexual abuse material or exploitation.
- Non-consensual sexual content.
- Content that facilitates exploitation, trafficking, or abuse.
- Malware or malicious payloads.
- Content intended to cause significant harm to individuals or organizations.
3.5 SHAFT & Regulated Content
Certain categories of content may be restricted, prohibited, or subject to additional approval depending on jurisdiction, carrier, messaging channel, recipient age, consent requirements, and applicable law.
These may include:
- Sexually explicit or adult-oriented content.
- Hate or discriminatory content.
- Alcohol-related marketing.
- Firearms, weapons, or weapon-related products.
- Tobacco, nicotine, vaping, or related products.
Customers must not assume that a category is permitted merely because it is lawful in a particular jurisdiction. Carrier, operator, channel, or platform restrictions may impose additional limitations.
WiseLiquid may reject or restrict such traffic where required by law, carrier policy, upstream provider requirements, or internal risk controls.
04. Restricted & High-Risk Use Cases
Certain use cases may require prior written approval, additional verification, enhanced monitoring, documentation, or may be prohibited entirely.
Examples include:
- Financial services and lending.
- Insurance and investment-related communications.
- Healthcare and pharmaceutical communications.
- Political or election-related messaging.
- Charitable fundraising.
- Cryptocurrency and digital-asset services.
- Gambling or gaming-related services.
- Adult-oriented businesses.
- High-volume promotional campaigns.
- Authentication and OTP traffic at unusual volumes.
- Services involving highly sensitive personal information.
- Communications involving minors.
- Any business model that presents elevated fraud, abuse, chargeback, regulatory, or carrier risk.
WiseLiquid may request additional information before approving or continuing such traffic.
05. Sender Identity & Content Integrity
Customers must use accurate and authorized sender identities.
You must not:
- Use a sender ID belonging to another organization without authorization.
- Impersonate another brand or organization.
- Rotate sender identities to evade filtering.
- Misrepresent the origin or purpose of a communication.
- Use misleading URLs or domains.
- Modify message content to circumvent spam or carrier filtering.
- Use URL shorteners or redirect mechanisms for deceptive purposes.
Where applicable, sender IDs, templates, headers, registered entities, DLT information, business profiles, and other communication identifiers must accurately correspond to the customer and its approved use case.
06. SMS, RCS, WhatsApp, Email & Channel Compliance
Each communication channel may have its own technical, regulatory, and content requirements.
Customers are responsible for complying with:
- Telecommunications regulations.
- Carrier and operator policies.
- Sender registration requirements.
- Template approval requirements.
- Consent requirements.
- Opt-out requirements.
- Channel-specific business and messaging policies.
- Email authentication requirements where applicable.
- Provider and upstream aggregator requirements.
WiseLiquid may impose additional restrictions when required by an upstream provider, carrier, messaging platform, regulatory authority, or risk-control system.
Approval of a sender, template, campaign, domain, phone number, or account does not constitute legal approval of the customer's business or communication practices.
07. Consent, Opt-Out & Recipient Rights
Customers are responsible for obtaining valid consent where required before sending communications.
Consent records should be maintained in a manner appropriate to the applicable law and communication type.
Customers must:
- Respect recipient preferences.
- Process opt-out requests promptly.
- Avoid repeatedly contacting recipients who have withdrawn consent.
- Maintain suppression or do-not-contact lists where appropriate.
- Provide legally required identification and unsubscribe mechanisms.
- Ensure that third-party or purchased contact lists are not used where prohibited.
WiseLiquid may request evidence of consent where abuse complaints, carrier complaints, regulatory inquiries, or unusual traffic patterns are identified.
08. Data Protection & Personal Information
Customers must not use WiseLiquid Services in a manner that violates applicable privacy or data-protection laws.
You are responsible for:
- Collecting and processing personal information lawfully.
- Providing appropriate privacy notices.
- Obtaining required permissions and consents.
- Implementing appropriate security measures.
- Limiting access to customer and recipient data.
- Retaining data only for legitimate and lawful purposes.
- Handling data-subject requests where applicable.
- Not transmitting sensitive personal information through an inappropriate communication channel.
Customers must not upload or transmit passwords, private encryption keys, authentication secrets, payment-card information, or other highly sensitive information unless the relevant service and applicable legal and security requirements expressly permit such processing.
09. Platform & Infrastructure Security
You must use WiseLiquid Services in a manner that protects the security, availability, and integrity of the platform.
The following activities are prohibited:
Rate Limit Evasion
- Circumventing API or messaging rate limits.
- Using multiple accounts to bypass restrictions.
- Manipulating traffic patterns to avoid automated controls.
- Attempting to overload messaging gateways.
Unauthorized Access
- Accessing another customer's account.
- Using compromised credentials or API keys.
- Credential stuffing.
- Brute-force attacks.
- Session hijacking.
- Circumventing authentication or authorization controls.
Security Exploitation
- Exploiting vulnerabilities without authorization.
- Deploying malware or malicious code.
- Attempting to compromise WiseLiquid infrastructure.
- DDoS or denial-of-service attacks.
- Port scanning or network scanning without authorization.
- Penetration testing without prior written approval.
- Attempting to access internal systems, databases, source code, infrastructure credentials, or confidential information.
Reverse Engineering
You may not:
- Decompile or reverse engineer WiseLiquid software.
- Attempt to discover undocumented APIs.
- Map undocumented endpoints.
- Circumvent technical restrictions.
- Extract or replicate proprietary platform functionality.
Authorized security testing may only be performed with prior written approval from WiseLiquid.
10. API, Credentials & Account Security
Customers are responsible for protecting their:
- API keys.
- Access tokens.
- Passwords.
- SMTP credentials.
- Webhook credentials.
- Integration credentials.
- Account recovery information.
Credentials must not be:
- Publicly exposed.
- Committed to public repositories.
- Shared through insecure channels.
- Embedded in publicly accessible client-side applications where avoidable.
- Shared with unauthorized users.
If you suspect that credentials have been compromised, you must immediately revoke or rotate the affected credentials and notify WiseLiquid where appropriate.
WiseLiquid may suspend credentials that appear compromised or are associated with suspicious activity.
11. Traffic Quality & Abuse Prevention
WiseLiquid may monitor traffic characteristics to protect its platform and communication ecosystem.
Monitoring may include:
- Message volume.
- Sending patterns.
- Delivery and failure rates.
- Bounce rates.
- Spam complaints.
- Recipient complaints.
- Opt-out rates.
- Content characteristics.
- Destination patterns.
- Account behavior.
- API usage.
- Authentication and security events.
Customers must not intentionally manipulate traffic metrics or attempt to hide abusive traffic.
Examples include:
- Artificially distributing traffic across accounts.
- Rotating credentials to avoid enforcement.
- Splitting campaigns to bypass limits.
- Changing message content solely to defeat filtering.
- Creating multiple accounts to continue prohibited activity.
12. Domains, URLs & Landing Pages
Customers are responsible for all domains, URLs, websites, landing pages, applications, and destinations referenced in their communications.
You must not use WiseLiquid Services to distribute links that:
- Lead to phishing pages.
- Distribute malware.
- Facilitate fraud.
- Redirect users deceptively.
- Impersonate legitimate organizations.
- Hide the final destination for malicious purposes.
- Promote prohibited or illegal activities.
WiseLiquid may block domains, URLs, IP addresses, or other destinations associated with abuse, fraud, malware, spam, or policy violations.
13. Customer Responsibilities
Customers are responsible for:
- The legality and accuracy of their communications.
- Their recipient databases and contact sources.
- Consent and opt-out management.
- Their content and campaigns.
- Their users and sub-accounts.
- Their applications and integrations.
- Their API credentials.
- Their domains and landing pages.
- Their regulatory and industry compliance.
- Any third-party services connected to WiseLiquid.
Customers must promptly investigate and respond to recipient complaints, regulatory inquiries, security incidents, and abuse notifications relating to their traffic.
14. Monitoring, Investigation & Compliance Review
WiseLiquid reserves the right to monitor, investigate, restrict, or review account activity when reasonably necessary to:
- Protect the platform.
- Protect customers or recipients.
- Prevent fraud or abuse.
- Investigate security incidents.
- Comply with applicable law.
- Respond to carrier or provider requirements.
- Respond to regulatory requests.
- Maintain messaging quality and deliverability.
- Enforce this AUP.
Where legally permitted, WiseLiquid may request information or documentation relating to a customer's business, traffic sources, consent practices, sender identity, campaign purpose, or recipient lists.
Failure to provide requested information may result in temporary or permanent restrictions.
15. Enforcement & Remedial Actions
If WiseLiquid determines or reasonably suspects that an account is violating this AUP, WiseLiquid may take one or more actions depending on the circumstances:
- Issue a warning.
- Request additional information or documentation.
- Reject or quarantine individual messages.
- Block specific content, URLs, destinations, or sender identities.
- Apply traffic restrictions.
- Reduce sending limits.
- Disable specific communication channels.
- Suspend API credentials.
- Suspend or restrict an account.
- Permanently terminate an account.
- Withhold or restrict access to certain Services.
- Cooperate with carriers, providers, regulators, or law enforcement where legally required or appropriate.
For serious violations, WiseLiquid may take immediate action without prior notice.
Where an account is suspended or terminated because of an AUP violation, applicable fees, credits, prepaid balances, or other amounts may not be refundable to the extent permitted by applicable law and the applicable service agreement.
16. Emergency Suspension
WiseLiquid may immediately suspend or restrict Services where continued access reasonably presents a risk of:
- Fraud.
- Security compromise.
- Network disruption.
- Significant recipient harm.
- Regulatory violation.
- Carrier or provider suspension.
- Damage to WiseLiquid's infrastructure or reputation.
- Abuse of other customers or third parties.
Emergency action may be taken without prior notice where necessary to protect the platform or third parties.
17. Law Enforcement & Regulatory Cooperation
WiseLiquid may cooperate with law enforcement agencies, regulators, telecommunications operators, carriers, messaging providers, and other authorized entities where required by applicable law or where reasonably necessary to investigate unlawful activity, fraud, abuse, or security incidents.
WiseLiquid may preserve or disclose relevant information where legally required or permitted.
Nothing in this AUP limits WiseLiquid's ability to comply with valid legal orders, regulatory requirements, or mandatory reporting obligations.
18. Third-Party Services & Upstream Providers
WiseLiquid may rely on telecommunications operators, messaging aggregators, cloud infrastructure providers, email providers, RCS providers, WhatsApp providers, and other third-party service providers.
Customers acknowledge that such providers may impose additional requirements or restrictions.
If an upstream provider blocks, restricts, suspends, or rejects traffic, WiseLiquid may apply corresponding restrictions to the customer's account or traffic.
WiseLiquid is not responsible for restrictions imposed by third-party providers where those restrictions arise from the customer's content, traffic, business practices, or violation of applicable third-party requirements.
19. Reporting Abuse
If you believe that a WiseLiquid account, message, sender, domain, or communication is being used for fraud, spam, phishing, abuse, or other prohibited activity, you may report the matter to WiseLiquid through our designated support or abuse channels.
Reports should include sufficient information to allow WiseLiquid to investigate, such as:
- Sender information.
- Message content.
- Relevant timestamps.
- Recipient information where appropriate and lawful.
- URLs or domains involved.
- Screenshots or supporting evidence.
Do not include unnecessary sensitive personal information when submitting an abuse report.
20. Policy Changes
WiseLiquid may modify this AUP from time to time to reflect changes in:
- Laws and regulations.
- Carrier requirements.
- Messaging-platform policies.
- Security standards.
- Industry practices.
- WiseLiquid Services.
- Abuse and fraud patterns.
The updated version will be published through the applicable WiseLiquid website or customer portal.
Your continued use of the Services following an effective update constitutes acceptance of the revised AUP to the extent permitted by applicable law and your agreement with WiseLiquid.
21. Relationship With Other Policies
This AUP should be read together with WiseLiquid's:
- Terms of Use.
- Privacy Policy.
- Cookie Policy.
- Service-specific terms.
- Data Processing terms, where applicable.
- Customer agreements and order forms.
- Applicable channel and provider requirements.
If there is a conflict between this AUP and a signed customer agreement, the applicable contractual terms will govern to the extent of the conflict, unless otherwise required by law.
